Terms and Conditions
These Terms and Conditions (“Terms and Conditions”) apply to all reservation requests, bookings, and events contracted between the client (“Client”, “you”, or “your”) and SwissMixx Audio and SwissMixxAudio.com (“SwissMixx”) for professional sound and audio services, DJ services, or other requested services related to the reservation and event (“Services”).
By requesting a reservation and/or paying a deposit, you, the Client, agree to be bound by these Terms and Conditions.
Please note that the reservation and booking forms provided at SwissMixxAudio.com are provided for convenience only. Using the forms does not guarantee space or service. Your reservation can only be guaranteed once all event details are finalized and your deposit successfully paid. SwissMixx cannot be held liable for site, reservation form, or payment processing errors. All reasonable efforts will be made to confirm reservation details and process payments in a timely manner.
A $350 non-refundable deposit is required for all reservations and must be paid in advance to hold the reservation.
The balance of payment for the total fee is due at least 48 hours before the event start date, unless otherwise agreed in writing. Credit/debit card payments are preferred, but payments may also be made by cash, check, or money order made payable to SwissMixx Audio. You are responsible to pay a $35.00 administration fee for each returned (“bounced”) check. If payment is not received before the start of the event equipment will not be setup and no refund will be given. In the event you are given net 30 any payment after net 30 will be assessed a 25% fee of the balance.
Once confirmed by completing the reservation form, making a reservation request via email, and/or paying the non-refundable deposit, your reservation cannot be cancelled or modified except in writing either by you or SwissMixx. If you cancel less than 30 days prior to the event, you are responsible for the total fee. At its sole discretion, SwissMixx may accommodate rescheduling for events cancelled due to inclement weather, serious injury, or death. Rescheduled events are subject to availability. In the unlikely event of a cancellation initiated by SwissMixx, SwissMixx liability shall be limited to the value of any unused time in connection with the reservation, with credit or refund issued to you at the sole discretion of SwissMixx. If a refund is offered SwissMixx will have 30 days to process and issue the refund.
When feasible, you may request extended service time during the event. Overtime requested may be made in one-hour increments at the rate of $100 per hour and $150 per hour after midnight. Payment for overtime is due at the time the request for overtime is made, payable by credit/debit card, check, cash, or money order.
Unless otherwise agreed in writing, you confirm that:
- performance facility will provide SwissMixx a working space approximately 12′ by 8′ in an area within 25 feet of two 110 volt outlets on separate circuits (3 prong grounded);
- facility is open at least three hours prior to scheduled start time;
- facility meets all state and federal safety regulations;
- reasonable steps will be taken to protect SwissMixx equipment and personnel;
- for outdoor performances, event location shall provide shelter that completely covers and protects SwissMixx equipment from adverse weather conditions.
You accept full responsibility and are liable for any damages, injuries, or delays that occur as a result of failure to comply with these provisions. In the event of circumstances deemed by SwissMixx to present a real or implied threat of injury or harm to SwissMixx personnel or equipment, or to be otherwise unsafe, SwissMixx reserves the right to cease or cancel performance, without refund.
If any provisions of this Agreement shall be held invalid, the remainder shall, nevertheless, be deemed valid and effective. In the event of a conflict between parties, disputes shall be resolved via arbitration in the State of Utah.
